Deep Dive 2026: Prediction Markets & the New Battle Over Gaming Law
MONDAY, MARCH 30
1:00 PM – 2:00 PM Prediction Markets: When Federal Oversight Fails (S-491)
Prediction markets moved from the margins to the center of national wagering debates by exploiting regulatory ambiguity. Platforms like Kalshi expanded as the Commodity Futures Trading Commission failed to define clear limits or enforce its mandate. Weakened federal oversight and delayed enforcement allowed event-based wagering to scale nationally before states, tribes or consumers had a meaningful voice. This segment grounds attendees in how this moment was created and why it marks a critical inflection point for gaming law.
Moderator: Jason Giles, Executive Director, Indian Gaming Association
Tres York, Vice President, Government Relations, American Gaming Association
2:00 PM – 3:00 PM Prediction Markets: The Redefinition of Gambling (S-492)
Prediction markets are reshaping the legal definition of gambling by framing wagers on real-world events as financial instruments. By treating event-based contracts as derivatives rather than bets, these platforms challenge long-standing gaming law and jurisdictional authority. This reframing shifts decision-making away from legislatures and regulators and into the courts, creating legal precedent that could permanently alter how wagering is defined, regulated and enforced nationwide.
Moderator: Victor Rocha, Conference Chairman, Indian Gaming Association

Elizabeth Homer, Principal Attorney, Homer Law
3:00 PM – 4:00 PM Prediction Markets: From Defense to Strategy
Tribes must shift from reactive litigation to coordinated, forward-looking action. As prediction markets expand, waiting for courts or regulators to act increases risk and weakens leverage. Building unified legal positions, aligning timing across jurisdictions and shaping the narrative before precedent is set become essential to protecting gaming law and regulatory authority through early, collective action.

4:00 PM – 5:00 PM Building the Coalition for the Fight Ahead
Tribes can expand the response beyond Indian Country by engaging states, attorneys general, regulators and aligned industry and policy organizations. Identifying shared interests around consumer protection, lawful markets and regulatory authority allows for coordinated pressure across legal, political and public forums. Coalition-building becomes a force multiplier that raises the cost of inaction and accelerates accountability.
