Casino Gambling Expansion Returns to New Jersey Legislative Agenda

Two reintroduced measures in New Jersey’s 2026 legislative session have reopened a bitter debate over expanding casino gambling and banning smoking on casino floors.

SCR66, sponsored by Senators Vin Gopal and Paul Sarlo, seeks a constitutional amendment to permit casino gaming at Monmouth Park and the Meadowlands and to give the Legislature authority to set games and taxes. 

“The types and number of casino games which may be conducted at these racetracks, and the taxes imposed on these games, will be determined by the Legislature by passing a new law,” the resolution states.

Fiscal allocations in SCR66 would direct new revenue to tax relief, education and pension costs, underscoring the political stakes as the bills begin committee review.

The renewed debate comes as Atlantic City operators continue to invest heavily in their existing footprints rather than pursue geographic expansion. Ocean Casino Resort has detailed a multi-year capital investment programme focused on hotel upgrades, gaming floor enhancements and non-gaming amenities. 

Smoking Ban Returns Alongside Possible Casino Gambling Expansion

The companion resolution, Senate Bill 212, sponsored by Senators Shirley Turner and Joseph Vitale, would eliminate the Smoke-Free Air Act exemption that currently permits smoking in casinos and simulcasting facilities and would take effect 90 days after enactment. 

According to AP News, a senate introduction back in 2024 showed alternative proposals , including a bill to allow smoking on up to 25% of floors with ventilated rooms and voluntary staffing.
